LEGAL ENTITY & JURISDICTION
Prosperous Partner Services ("the Company") operates under the laws of Malaysia and internationally. This is a binding Agreement of Adhesion.
1. Data Disclosure Obligation
The User must provide exhaustive, accurate, and verified biographical data, metrics, and imagery as a condition of service. This data is the proprietary fuel for the Prosperous Partner Formulation Algorithm. Submission of fraudulent or "placeholder" data constitutes a material breach, granting the Company the right to terminate access immediately without notice or compensation.
2. Disclaimer of Precision
Results are generated via a proprietary algorithm and are provided as estimates only. The Company makes no warranties regarding precision, reliability, or compatibility. The User assumes all risk regarding the interpretation of these results. The User covenants not to sue the Company for any result deemed imprecise, unsatisfactory, or causing personal disappointment.
3. Limitation of Liability & Zero-Compensation Policy
To the maximum extent permitted by law, the Company is exempt from liability for:
- Security: Unauthorized third-party interference, hacking, data scraping, or theft of personal data.
- Financial: Intercepted transactions (processed by third-party gateways).
- Recourse: The User is barred from seeking monetary compensation, damages, or refunds for any loss (financial or data-related) arising from use of the platform, except where strictly mandated by law.
4. Intellectual Property & Prosecution
The Prosperous Partner Formulation and its algorithms are trade secrets protected under the Malaysian Copyright Act 1987 and international treaties. Reverse-engineering, misappropriation, or "scraping" is prohibited. The Company reserves the right to pursue criminal prosecution and civil litigation seeking maximum punitive damages against violators.
5. Fees & Payments
Registration and profile creation are complimentary. Fees are strictly applicable only upon the voluntary activation of premium services, reports, or proprietary features.
6. Governing Law & Arbitration
This Agreement is governed by the laws of Malaysia. Disputes must be submitted to Final and Binding Arbitration at the Asian International Arbitration Centre (AIAC) in Kuala Lumpur.
